22. Colorado Rule 70 QDRO Enforcement


Use Colorado Rule 70 to enforce the approval and processing of a QDRO when one of the Parties is uncooperative and will not sign the QDRO.

A Rule 70 motion and court order authorizes the Clerk of the Court to sign the QDRO in place of the uncooperative Party.

Otherwise, the Judge will not approve an unsigned QDRO. And the retirement plan administrator will not process the QDRO.

Rule 70 can be used for other purposes, such as signing a real estate deed, car title, insurance documents, IRAs, etc.

The court should assess attorney fees against the uncooperative Party.
