15. Federal TSP RBCO Divorce Division


The Federal TSP retirement plan is similar to a 401(k) plan and it can be divided in a Colorado divorce.

Since it is a government plan, you use an RBCO (Retirement Benefits Court Order) instead of a QDRO.

It is available to both Military and Civilian employees.

Now enrollment is mandatory. However contributions are still voluntary.

Loans may be taken from the TSP account.

Make sure your separation agreement includes the valuation date (or CRS 14-10-113(5) applies) and whether or not there is a loan. If there is a loan, will the Alternate Payee be debited (charged) for a portion of the existing loan balance?
